ZCAInstantQuiz Terms and Conditions

By means of these terms and condition set forth herein (“Terms and Conditions”), Zee Entertainment Enterprises Limited (“Company”) is conducting a promotional activity / flash contest named “Zee Cine Awards Instant Quiz” (Herein referred as Contest) to promote the Programme ‘Zee Cine Awards – 2025’ to be telecasted  on Zee Cinema / Zee TV and other Zee Channels (“Channel”) by providing an opportunity to the interested viewers (“Participant(s)”) to submit their Entry (as mentioned below) from their Facebook Account and/or Instagram Account via Facebook and Instagram page (https://www.facebook.com/zeecineawardsofficial and / or https://www.instagram.com/zeecineawards/?hl=en) of Zee Cine Awards on that social media platform provided by the Company (“Entry Platform”) and details of which shall be available on the social networking platforms of the Channel during the Activity Period and get a chance to win the Gratification (as defined hereunder) (“Activity”) on terms more particularly described herein below which you agree to be unconditionally bound by:

    I. PROCEDURE FOR PARTICIPATION AND SELECTION

    1. In order to participate in the Activity, each Participant needs to fulfil the following requirements:-
       i. The Contest shall be announced on 24th Jan 2025 on Zee Cine Awards      Facebook and Instagram pages. The Contest shall be held between the period of 24th January 2025 to 8th March 2025, wherein, multiple questions will be asked, during the contest period, at the discretion of the company.
      ii. The Company shall upload a Bollywood/Zee Cine Awards related trivia question with 4 options to choose from. The participants need to answer the correct option as a comment of the post and tag 3 people in the same comment.
      iii. The participants need to be followers of the Zee Cine Awards Facebook / Instagram page that they are answering on.
      iv. The participants need to answer by 11:59 pm IST on the same day the question is posted.
      v. The Participants needs to be of 18 years or above.
      vi. The Contest is open for Participants across India.
      vii. It is hereby clearly stated to the Participant that out of the correct entry which is submitted by the participant and subject to the Participant satisfying the eligibility criteria / conditions of clause 1 (ii) to 1 (vi) hereinabove the Company shall randomly shortlist the Participants. The Participants will be sent a DM for additional information related to themselves which may include their Name, Age, Contact Number & Email ID. The Participants shall respond withing 24 hours from such request of the Company. It is further clarified that in the event the Participant does not respond within 24 hours with the requisite details, the Company shall be at liberty to shortlist another eligible Participant at its sole discretion.
      viii. The Participant shall further be called upon to collate data like Name, Detailed Address, Age, Gender, Email id to have a chance to win the Gratification (as defined below) (“Entry”).

    2. The Activity Period for the Activity shall be from 24th January, 2025 and shall continue till 11:59 PM IST on 8th March 2025 (“Activity Period”). The entries of the participants shall be till 11:59 PM IST of the day the question is posted for each question. The Company at its sole discretion can increase or decrease Activity Period without giving any prior intimation to the Participant(s). For the sake of clarity, the Participant(s) shall not hold the Company liable for non-intimation for the increase or decrease the Activity Period.

    3. The Company may further promote this Activity through the medium of the Channel, Website, print media (newspapers), radio, television (promos, astons, bugs etc.), on ground promotions, push SMS, radio, digital media/ online and any other manner as shall deem fit by the Company, at its sole discretion, stating the mechanism in which the Participant(s) can participate in the Activity.

    4. It is further clarified that the details of the Entry may be publicized on the Channel and any other channel owned and/or operated by the Company and /or any other platform/medium other than the Entry Platform.

    5. For purposes of the Activity, “receipt” of the Entry shall be considered by the Company only when the Entry submitted by Participant(s) is received by the Company and visible to the Company on the Entry Platform.

    6. For the purposes of the Activity, a complete and valid Entry will constitute of (i) Participant(s) to submit their correct answer to the uploaded Bollywood/Zee Cine Awards related trivia question with 4 options on Zee Cine Awards Facebook and Instagram page as a comment on the post & tag 3 people in the same comment and subject to the the participants need to be followers of the Zee Cine Awards Facebook / Instagram page that they are answering on (Entry Platform); The participant should answer by 11:59 pm IST on the same day that the question is posted (ii) Entry to be made by Participants for self and not on behalf of anyone (iii) Entry once posted/uploaded by the Participant on Entry Platform, cannot be modified further by the Participant (iv) Participants to submit their personal details along with the Entry e. name, age, city, email ID and registered mobile number (if they are contacted and the same is asked of them). If the Participant(s) fails to make the Entry in the manner as stated hereinabove and/or has violated any guidelines published/messaged on the Entry Platform, then his/her Entry shall be considered incomplete and the Participant(s) shall not be eligible for the Gratification. For the avoidance of doubt, it is hereby clarified that by submitting the Entry, the Participant(s) is representing that the Entry or contents thereof are not confidential or comprise any sensitive personal information.

    7. The Company shall at its sole discretion consider the Entry submitted by him/her as valid Entry in accordance with Clause 1 for the purpose of the Activity. Any Entry received from the Participant(s) which is contrary to the terms mentioned above on the Entry Platform(s) during or after the Activity Period shall be considered null and void.

    8. The Participant(s) shall ensure that the Entry submitted on the Entry Platform and any post made by the Participant(s) related to the Activity on Facebook and Instagram will be in compliance with applicable laws, and is not immoral, defamatory, abusive, offensive, insensitive, libelous or blasphemous to any person (living or dead), religious sect or section of the society, or infringe the rights of any third party including intellectual property etc. Participant shall not host, display, upload, modify, publish, transmit, update or share any information that —
      (a) belongs to another person and to which the user does not have any right;

      (b) is grossly harmful, harassing, blasphemous defamatory, obscene, pornographic, pedophilic, libelous, invasive of another’s privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever;

      (c) harms minors in any way;

      (d) infringes any patent, trademark, copyright or other proprietary rights

      (e) violates any law for the time being in force;

      (f) deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;

      (g) impersonate another person in a defamatory manner;

      (h) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource;

      (i) threatens the unity, integrity, defense, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation. For avoidance of doubt, the Participant(s) agrees that the Company has the right to remove any such material/post which may not be in consonance with applicable law.

      * Further, Participants agree that the Company shall not be liable or responsible for the Entry made by the Participants and/or for any claim/liability (including claim from third party) with respect to Entry, if made in violation of any term/provision (as part or full) of this entire clause no.9.

    9. The Company shall not be responsible in the event Entry is not received due to any technical error and/or connection failure and/or electricity failure and/or for any reason whatsoever.

    10. At the end of the Activity Period, on the basis of the Participant(s) having submitted a valid Entry on the Entry Platform in accordance with Clause 1, the Company’s Agency, The Company or any agency hired by the Company at it’s sole discretion shall collect all Entries and thereafter randomly select a total number of 10 (Ten) Participants per question during the Activity Period who shall be selected as Winners, which shall be decided at the sole and absolute discretion of the Company. Company shall announce and promote the Winners, at its sole discretion on any social media, digital platform of the Company including that of the Channel and the Company at the sole discretion of the Company. The Company shall declare the names of the Winners on its Social Media handles and they will also be awarded a Gift Voucher of INR 500/- (Indian Rupees Five Hundred Only) (“Gratification”). The Company shall provide Gratification subject to verification process as mentioned in Clause 1. The Winner(s) wining the Gratification(s) once shall not be eligible to win the Gratification again during the Activity Period. The Company shall at the sole discretion decide the Gratification. It is further clarified that the Winners shall be declared at the sole discretion of the Company.

    11. For avoidance of doubt, it is clarified that apart from the Gratification, the Winner shall be not entitled for any other gratification/ opportunity whether monetary or otherwise. Notwithstanding anything contained herein these Terms and Conditions, the Company shall have the sole discretion to choose and finalize the form of the Gratification and the Participant shall have no claim in any manner whatsoever in this relation (if applicable). The Participant understands and agrees that the Company shall have full discretion, without informing the Participant, to change the form of Gratification and the Participant shall abide by the Company’s decision to this effect.

    12. For avoidance of doubt, it is clarified that the Company’s decision and prerogative in regard to the selection and declaration of the Winner shall be final and binding. The Company at any time during or after the expiry of the Activity Period shall at its sole discretion increase or decrease the number of Winners to be selected by the Company for being entitled to receive the Gratification. For the sake of clarity, mere submitting an Entry on the Entry Platform does not entitle the Participant(s) to receive the Gratification. Only the Participant(s) who have made a valid Entry on the Entry Platform in accordance with Clause 1 during the Activity Period shall get a chance to proceed further for the selection process in the Activity at the sole discretion of the Company.

    13. All the Participants have to check the Zee Cine Awards Social Media pages i.e. Facebook and Instagram in order to know who have been selected as Winners and which Entries shall be featured on the Channel. Once the Entries of the Participants(s) are accepted, the shortlisted Participants shall get a direct message (DM) on their Facebook / Instagram profile as provided by them and they have to provide their Personal information / documents in a manner/ way desired by the Company within 24 hours (“Verification Message”). 

    14. The Company and/ or any other agency of behalf of the Company shall make only one (1) attempt to contact the Winner(s) by direct messaging to the Winner(s) registered with the Company. In case the Winner(s) fails to respond within 24 hours, the selection of that particular Winner shall be invalidated and the Company at its sole discretion may select another Winner from amongst the eligible Participant(s) who qualify as per the criteria stated above to receive the Gratification. The Company shall not be responsible or liable for any technical disruption and/or failure/ and/ or any other difficulties of such nature, due to which the Winner is un-reachable, due to which the Company is unable to intimate the Winner.

    15. The Verification Message shall have instructions on the process required to be adhered by the Winner(s) which inter alia shall include the personal information (“PI”) of the Winner(s) such as name, contact number/mobile no, email id, age, gender, residential address etc. The Winner(s) shall be requested to furnish documents to the Company such as (i) identification documentation such as, PAN card, residence proof, their nationality proof such as Masked Aadhar card / election card/valid and subsisting passport/ permanent driver’s license/active bank details) and/or any other details required by the Company (“Documents”). For the sake of clarity, Verification Call received by each Winner shall only be for the purpose of verifying the details and not be treated / implied as Winner of the Activity in any manner whatsoever.

    16. The Winner(s) shall furnish all requisite PI and Documents in a form and manner desired by the Company over Verification Call. Post receiving the PI and Documents of the Winner(s) the Company shall verify the necessary PI and Documents at its end.

    17. In the event any Winner fails to provide the above mentioned PI and/or Documents within 24 hours or fails to adhere to the instructions as mentioned in the Verification Call, the Winner’s selection shall be invalidated and the Company shall not be liable to that Winner in any manner whatsoever. Additionally, the Company may at its sole discretion select another Winner from amongst the eligible Participant(s), who qualify as per the criteria stated above.

    18. Once PI and/or Documents are verified by the Company, the Company and /or any other agency on behalf of the Company shall inform the Winner(s) about their selection as one of the Winner(s) of the Activity and such person shall be entitled to Gratification.

    19. ‘It is clarified that Gratification given to the Winner by the Company is non-transferrable, non-exchangeable and personal in nature, hence the Winner cannot transfer the opportunity to any other person. Winner agree and undertakes that no cash equivalent or alternative gratification/ opportunity will be given to the Winner and the Winner cannot exchange the opportunity given for any kind of gift with value.

    20. The Winner shall not in any circumstances make any claims against the Company and/or its affiliates and/or its group companies arising out of or relating to any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly or any related activity, to the extent permitted under law. If any of the Winner is found to be ineligible, or if he or she has not complied with any of the Terms and Conditions, the corresponding Entry will stand disqualified and such decision shall be final and binding.

    21. Family members and relatives of the employees of the Company and their group companies, affiliates, subsidiaries, holding companies are not eligible to participate in the Activity.
    22. No dispute shall be entertained with regards to the selection criteria. Decisions of the Company shall be final and binding on the Participant(s).

    23. The Winner may have to sign one or more release forms or other relevant documents as required by the Company in order to receive the Gratification from the Company.

    24. The Winner hereby agrees to release and discharge the Company and/or its affiliates and/or its group companies from all Gratification and Activity related obligation on the Company delivering/ handing over the Gratification to the Winner.

    25. All PI and Documents requested by and supplied to the Company by each Participant must be truthful, accurate and in no way misleading, failing which the Company reserves at its sole discretion the right to disqualify such Participant from availing the opportunity to participate in the Activity.

    26. By participating in the Activity, it is construed that the Participant(s) has read and understood these Terms and Conditions, Privacy Policy including the General Terms and Conditions stated below and Participant(s) act of participation in the Activity will be deemed acceptance to abide by the same.

    27. Grounds for disqualification to the Contest:
    • Participants who are not eligible to participate in the Contest;
    • Participants who are not 18 (Eighteen) years of age or above.
    • Participants who do not tag 3 people
    • Participants who are not followers of the Zee Cine Awards Facebook / Instagram page that they are answering on
    • Participants do not answer the question on the same day ( by 11:59 pm IST) that the question is posted
    • Participants/ Winners failing to provide DM, the required documents / details as stated above, within 1(One) day of request by the Company; 
    • Any of the documents/proofs not being properly attested, unclear, illegible and/or the Company has reasonable grounds to believe the same to be fraudulent.
    • Entry submitted by proxy will not be accepted, even if the proxy is any of their family members.
    • circumstances which, in the Company’s view, renders the Participant unfit to participate therein
    • non-confirmation to comply with the rules and regulations as specified herein by the Company.
    • if the Participant has acted in any manner detrimental to the reputation and goodwill of the Company, Zee Cine Awards and the contest.
    • for any other reason as the Company may deem fit and proper in its absolute discretion.

 

    II. GENERAL TERMS AND CONDITIONS

    1. Participation is open to all citizens who (i) are residing in India (ii) is medically fit (iii) have no criminal conviction and (iv) an arrangement or a contract with any third party that prevents the Participant(s) from participating in the Activity. Documents pertaining to medical fitness (if required) must be furnished by the Participant on demand.

    2. Each Participant must submit their Entry on their own behalf and Entry submitted by proxy will not be accepted, even if the proxy is any of their family members. By submitting the Entry on the Entry Platforms, the Participant(s) acknowledge that they have reviewed the entire Terms and Conditions and agree to the same.

    3. The Company reserves all rights to make amendments to the existing Terms and Conditions or withdraw the Activity without giving prior notice. It shall be the sole responsibility of the Participant(s) to check the Terms and Conditions of the Activity on the Channel’s Page being https://zeecineawards.com/

    4. The Participant(s) hereby undertakes, warrants and guarantees to the Company that he/she has the full legal capacity to participate in the Activity in accordance with law and also these Terms and Conditions.

    5. By participating in the Activity, the Participant(s) represents that he/she is medically fit and does not have present or past psychological problems. If in the past he/she has had any psychological problems or have been under medication for any psychological, anxiety, hypertension, depression or any other medical problems, the same shall be disclosed to the Company in writing along with a copy of the certificate from a qualified medical practitioner declaring him to be fit for participation in the Activity.

    6. Participant shall not be eligible as a Participant for the Activity if he/she is suffering from any critical health-related issues.

    7. Participant(s) represents that he/she has not been accused or convicted or is otherwise involved in any criminal offence and/or is not under inquiry or trial by the police or judiciary which has not been disclosed to the Company in writing or that the Participant(s) is /are not required to be present before any authority including police or any court of law for a term of twelve (12) months from the date of registration and has no other disability which would prevent or impede his/her participation in the Activity (if selected/shortlisted).

    8. The Participant(s) acknowledges that he/she has voluntarily chosen to participate in the Activity at his/her free-will and is willing to bear all risk, costs (including but not limited to food, travel, incidental costs) and consequences arising from such participation in the Activity.

    9. The Company makes no representations, warranties nor provides any undertaking to any of the Participant(s) that any or all of the Participants will be able to qualify for receiving the opportunity to participate in the Activity.

    10. The Participants who are medically unfit will not be eligible to participate in the Contest.

    11. The Company and/or its affiliates and/or its group companies shall not be liable/responsible for any lost opportunity, damages, losses, costs, and expenses or otherwise, suffered/incurred by any of the Participant(s) in the event the Company is not able to permit the Participant to take part in the Activity in accordance with any of the foregoing provisions.

    12. Notwithstanding any other provisions mentioned herein, the Company and/or its affiliates and/or its group companies may, at its sole and absolute discretion, decide to cancel the Activity or reschedule the Activity dates.

    13. At no point of time will the Company be obliged to notify unsuccessful Participant(s) of its decision.

    14. The Winner agrees that they shall make themselves available from time to time and co-operate with the Company and/or its affiliates and/or its group companies and participate in any activity and/or campaign relating to the Activity (“Promotional Activity”) of any nature whatsoever without any money payable to the Winner. Further, the Winner shall at no point of time refuse or disagree to participate in any such Promotional Activity for any reason whatsoever. The Winner gives his/her consent to the Company and/or its affiliates and/or its group companies and/or any other agency on behalf of the Company and/or its affiliates and/or its group companies to make the footage of the participation in the Activity. The Winner, in consideration of being afforded an opportunity to take part in the Activity, agrees that the footage of any nature with regard to the them shall vest with the Company and/or its affiliates and/or its group companies, including but not limited to all intellectual property rights and any other rights for worldwide and in perpetuity and the Company and/or its affiliates and/or its group companies may exploit the same in any manner and in any media whatsoever at any time throughout the world.

    15. The Participant(s) shall hold harmless and indemnify the Company its affiliates, its group companies, their employees, officers, directors or any other person from and against any injury/damage/harm/loss/death/mental or emotional trauma suffered by the Participant(s) and/or the Winner in connection with the Activity and/or the Gratification and also to the extent possible under law, waives all rights to file in person/ through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India to claim any damages or reliefs.

    16. The Participant(s) and/or the Winner shall hold harmless and indemnify the Company, its affiliates, its group companies, their employees, officers, directors and/or any other person from and against any suit /litigation /injury /damage /harm/loss suffered by the Company in connection with any act of the Participant(s)/ Winner and/or the Activity and/or Entry and/or any third-party rights claims with respect to the material submitted by the Participant(s)/ Winner.

    III. OTHER TERMS

    1.  If any provision of these Terms and Conditions is held by any court or other competent authority to be void or unenforceable in whole or part, the other provision of these Terms and Conditions and the remainder of the affected provisions shall continue to be valid.

    2. These Terms and Conditions shall be governed by and construed in accordance with the laws of India and subject to exclusive jurisdiction of the competent Courts in Mumbai.

    3. The Company is empowered to take a decision on any case not covered by the present Terms and Conditions.

    4. Each provision of this Terms and Conditions shall be considered severable, and if for any reason any provision(s), or the application of such provision(s) to any person, entity or circumstance, shall be held invalid or unenforceable, such provision(s) shall be ineffective to the extent of such invalidity or unenforceability without invalidating the remaining provisions hereof, or the application of the affected provision to persons, entities or circumstances other than those to which it was held invalid or unenforceable.

    IV. NO LIABILITY

    1. The Company and/or its affiliates and/or its group companies is in no manner whatsoever responsible and/or shall not be held liable, for any physical injury, death, mental trauma caused to any Participant(s)/Winner in any manner whatsoever, in relation to participation in the Activity.

    2. The Company and/or its affiliates and/or its group companies, shall be under no liability whatsoever to the Participants, in respect of any loss, damage suffered by the Participant arising from or pursuant to the Activity or for any and all loss, damage, cost, expense or injury to life or property sustained by the Participant at any stage of the Activity whether or not caused by (1) the Participant’s participation in the Activity, or being selected or disqualified; (2) as a result of the decisions of the Company; and/or (3) any printing, typographical or technological errors in any materials associated with the Activity. Notwithstanding the generality of the foregoing, the Company expressly excludes liability for all direct, indirect and consequential loss or damage, including but not limited to loss or damage to property or for loss of profit, business, revenue, goodwill or anticipated savings pursuant to participation in the Activity. In no event will the measure of damages include, nor will the Company and/or its affiliates and/or its group companies be liable for, any amounts for indirect, incidental, consequential, or punitive damages of any party, including third parties; or for damages attributable to the Participant; or circumstances beyond the Company’s reasonable control.

    3. The Participant/Winner agrees that he/she shall hold harmless the Company and/or its affiliates and/or its group companies, their affiliates, subsidiaries, group companies, their respective employees, officers, sub-contractors or any other person in connection with the Activity including but not limited to persons connected to the selection procedure for the Activity.

    4. The Company and/or its affiliates and/or its group companies or any of its affiliates will not be liable for any loss of earnings, employment or otherwise caused to the Participant/Winner arising as a result of their participation in the Activity.

    5. Company and/or its affiliates and/or its group companies shall not be held accountable/liable for any disruptions/stoppages/ interruptions or cancellation of the Activity on account of any force majeure factors or otherwise.

    6. Company and/or its affiliates and/or its group companies shall not be held responsible or accountable for any expenses, loss, injury or any other liability which may arise for the Winner, who is entitled to receive the Gratification.

    7. The Participant/ Winner hereby agrees to indemnify the Company or its affiliates or its group companies against any claims that might arise from his/her actions or omissions while participating in the Activity or due to any representations, misrepresentations or concealment of material facts by the Participant/Winner.

    8. If due to due to any unwanted situation or due to any other reason , the Events get cancelled or postponed , the Company shall not be responsible for the same and shall not be entitled to any kind of compensation and/or opportunity.

    9. Other Conditions apply.

ZCA (Zee Cine Awards) Instant Quiz: Privacy Policy

Zee Cine Awards Instant Quiz is a Contest(“Contest”) organized by  Zee Entertainment Enterprises Limited. The Contest is being conducted for citizens residing in India  aged 18 years and above. By means of the Contest/Campaign, the Company is providing an opportunity to interested persons to participate in the Zee Cine Awards Instant Quiz by picking the correct option as the answer to simple questions posted by Zee Cine Awards on Facebook / Instagram under the contest name ZCAINSTANTQUIZ and get a chance to win a voucher as gratification  ], subject to the terms and conditions available on << https://zeecineawards.com/ >>  (“Terms and Conditions”).

Zee Entertainment Enterprises Limited (“we”, “us”, “Company”) values the trust placed in us by data subject (“you”, “your”, “user”, “subscriber”, “customer”, “participant”) and therefore, we follow the highest standards of privacy guidelines to protect the information shared by you with us. 

This Privacy Notice (“Privacy Notice”) governs the use of Personal Information shared (as defined below) with or collected by Company from the participants of the Campaign in India The Company is the “Data Fiduciary” for the personal data discussed in this Privacy Notice. This Privacy Notice explains our practices, including your choices, regarding the collection, use, and disclosure of certain information, including your personal information in connection with the Campaign. 

For the purposes of this Privacy Notice references have been made to the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023 governing data protection in India, and all other applicable privacy laws.  

All capitalized terms that have not been specifically defined herein shall have the same meaning as provided under the Terms and Conditions. 

This Privacy Notice should be read in conjunction and together with the Terms and Conditions. 

  • Objective & Scope

    This notice applies to Participants of the Contest etc.  
    1. A “Participant” refers to an individual who is an interested viewer/person participating in the Contest and has willingly submitted their Personal Data to the Company.

         This Notice applies to Personal Data/Information, as defined below, that we collect to provide you with certain products and services, including the opportunity to participate in the Campaign (collectively, “Services”).

        This Notice does not apply to anonymized, de-identified or aggregate information if it is not Personal Information.   

  • Personal Data (Personally Identifiable Information-PII) –

    In line with applicable privacy regulations, the Company has classified all information relating to an identified or identifiable natural person which by itself or when clubbed with other information available can be used to identify a natural person or is associated with a consumer or household. The Company as a part of its business operations routinely handles various categories of personal data of its Users/Visitors. Such information is processed on a regular basis either directly by the Company or through third parties.  

User Consent 

By participating in the Contest you agree to provide consent to our collection, use and sharing of your Personal Data as described in this Privacy Notice.

Consent and Legal Basis

By visiting any website or by participating in the Campaign, you consent to collection and processing of your personal data as outlined in this Privacy Notice. This data processing is essential to fulfil the purpose of the Campaign. If you have not indicated that you do not consent to the use, we will assume that you consent to us processing the data for these purposes. TERMS AND CONDITIONS GOVERNING PUBLIC VOTING ACTIVITY TO BE CONDUCTED ON FOR ZEE CINE AWARDS 2024

ZEE Entertainment Enterprises Limited (“Company”) is organizing “Zee Cine Awards 2024”, (“Event”) which is an award show, to be telecasted on Zee Cinema and Zee TV and subsequent airings will be on other channels owned by the Company

By means of these terms and conditions set forth herein (“Terms and Conditions”), the Company is providing an opportunity to the interested viewers / participants (“Voter(s)”) to submit/cast his/her votes to select his/her favorite nominee from the  list of 06 (six) nominees nominated by the Company (individually referred to as the “Nominee” and collectively referred to as the “Nominees”) towards 4 (four) categories in the “Viewer’s choice” segment -Viewer’s choice – Best Actor (Male), Viewer’s choice – Best Actor (Female), Viewer’s choice – Best Movie, Viewer’s choice – Song of the Year. In respect of the same the Voter(s) can vote by (a) Heading on to the social media handles of Zee Cine Awards for Facebook www.facebook.com/zeecineawardsofficial, X ( formerly known as Twitter) –www.twitter.com/zeecineawards,       Instagram- www.instagram.com/zeecineawards or (b)  logging on the Company’s webpage being www.zeecineawards.com. or (c) using  Zee5 App (referred as “App”) or (d) via sending an SMS to 57575 with your entry in the manner mentioned below (individually referred to as the “Voting Platform” and collectively referred to as the (“Voting Platforms”) (“Activity”) on terms more particularly described herein below, which Voter agrees to be unconditionally bound by:

  1. PROCEDURE FOR PARTICIPATION IN THE VOTING ACTIVITY:

In order to participate in the Activity, each Voter shall be required to submit/cast his/her votes to select (“Voting Entry”) his/her favorite Nominee out of the various Nominees nominated by the Company in various category of award in the Event. For sake of clarity, there shall be 4(four) categories i.e. Viewer’s choice – Best Actor (Male), Viewer’s choice – Best Actor (Female), Viewer’s choice – Best Movie, Viewer’s choice – Song of the Year. Further each category shall have 06 (six) Nominees, nominated by the Company. Each Voter shall be required to submit the Voting Entry in any of the following manner:

 

 

  • Company’s website Entry:

To submit the Voting Entry via the Company’s Website, the Voters shall be required to log onto Company’s website being www.zeecineawards.com   and click on the page created for casting votes and submit his / her voting Entry for  the Best Actor(Male), the Best Actor (Female), the Best Film and the Best Song of the year from the various nominations choice under the various categories by filling on the necessary personal information on the Website more particularly his/her name, state, city, mobile number, email address   (collectively to be referred as “Personal Information”) and click on “submit” button. Once the Voter has successfully submitted his/her vote for all the categories mentioned above  and shared his/her the Personal Information, the Voter shall be directed to a page with a message acknowledging his/her successful submission of votes.

 

  • Zee5 Application Entry: The Voter shall be required to download the Zee5 Application on his/her handheld device and vote and submit their voting entries for their favorite Nominee as per instructions given on the App and cast their votes

 

  • SMS Entry: There shall be a Category Code and 6 Options assigned to each award category in the following manner:

          The Voter shall be required to send an SMS ‘ZCA       

           <space>Category Code <space>their choice (i.e.  A/B/C/D/E/F)

           along with their Name and city’ to 57575.

           For e.g. A voter can SMS ‘ZCA AM A Amit Nagpur’ to 57575 Each of above shall be individually referred to as the ‘Voting Entry” and collectively referred to as the “Voting Entries

 

  1. The Activity Period for Voting Activity shall start from 18th February 2024 and end on a date as notified by Zee. ZEEL reserves the right to change and/or extend the Activity Period for Voting Activity without giving any prior notice to the Voter(s). Such decision shall be final and binding on the Voter(s) and the same shall not be disputed and/ or challenged in a court of law or otherwise.

 

  1. The Company shall promote this Event and subsequent Voting Activity through the medium of the TV channel, website, media (newspapers), television (promos, astons, bugs etc.), radio, digital media/ online and any other manner as shall be deemed fit by the Company, at its sole discretion, stating the mechanism in which the Voters can submit the Voting Entry in the Voting Activity.

 

  1. It is further clarified that the details of the Voting Entries will be saved and stored in the Company’s data bank/ server and the data bank/server of Voting Platforms, to be utilized and publicized only for the purpose of the Voting Activity.

 

  1. For purposes of the Voting Activity, “receipt” of the Voting Entry occurs only:

 

  •  Social Media Platform: When the page/platforms successfully records Voters response

 

  • Company’s Website Entry: For the purposes of the Voting Entry made through the Company’s Website, a Voting Entry will be considered as complete and valid only when the Voter visits the Company’s Website and submits the Personal Information, votes for his/her favorite/preferred Nominee from various Nominees under different categories and clicks on the “submit” button.

 

  • Zee5 App: When the application system successfully record the vote casted/submitted by the Voter.

 

  • SMS Entry: When the SMS is successfully delivered

 

  1. If the Voter fails to make the Voting Entry in accordance to Clause I(1), Clause I ( 2) and Clause I (5) hereinabove then his/her Voting Entry shall be considered incomplete and the Voter shall not be eligible for selection for the purpose of Voting Activity. For the avoidance of doubt it is hereby clarified that by submitting the Voting Entry the Voter is representing that the Voting Entry or contents thereof are not confidential or comprise any sensitive personal information.

 

  1. Voting Entries received after the Activity Period of the Voting Activity shall be considered null and void.

 

  1. Determination of the winner(s) of the Event after the completion of Activity Period, votes received shall be tabulated by the Company in a manner as deem fit by the Company.

 

  1. The Voter shall ensure that the Voting Entry submitted is in compliance with applicable laws, and is not immoral, defamatory, abusive, offensive, insensitive, libelous or blasphemous to any person, religious sect or section of the society, or infringe the rights of any third party including intellectual property etc. Voters shall not host, display, upload, modify, publish, transmit, update or share any information that (a) belongs to another person and to which the user does not have any right; (b) is grossly harmful, harassing, blasphemous defamatory, obscene, pornographic, pedophilic, libelous, invasive of another’s privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever; (c) harm minors in any way; (d) infringes any patent, trademark, copyright or other proprietary rights; (e) violates any law for the time being in force; (f) deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature; (g) impersonate another person; (h) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource; (i) threatens the unity, integrity, defense, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation. For avoidance of doubt, the Voter agrees that the Company has the right to remove any such material/Post which may not be in consonance with applicable law.

 

  1. The Company and/or Voting Platforms shall not be responsible for any Voting Entries submitted by the Voters but not received or recorded due to any reason whatsoever including but not limited to technical disruption and/or network provider’s connection failure and/or any reason whatsoever. The services of Voting Platforms are provided “as-is” and as available and the Company expressly disclaims any warranty of fitness for a particular purpose or non-infringement. The Company and/or Voting Platforms cannot guarantee and does not promise any specific results from use of the services of the Voting Platforms in whatsoever manner.

 

  1. The Company assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, any user or member communication.

 

  1. The Company makes no representations that the Voting Platforms are appropriate or available for use in other territory outside India.

 

  1. The Voting Entry made is non-transferrable and non-exchangeable. Voter agrees and undertakes that no cash equivalent or alternatives will be given to the Voter for submitting the Voting Entry.

 

  1. The Voter shall not in any circumstances make any claims against the Company entities arising out of or relating to any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to the Voter’s participation in the Voting Activity or any related activity, to the extent permitted under law. If the Voter is found to be ineligible, or if he or she has not complied with these Terms and Conditions, the corresponding Voting Entry will stand disqualified and such decision shall be final and binding.

 

  1. Family members and relatives of the employees of the Company and their group companies, affiliates, subsidiaries, holding companies are not eligible to participate in the Voting Activity.

 

  1. No dispute shall be entertained with regards to the Voting Entry submission mechanism/ criteria and/or counting mechanism of the Voting Entries received by the Company. Decisions of the Company shall be final and binding on the Voter.

 

  1. By participating in the Voting Activity, it is construed that the Voter has read and understood these Terms and Conditions, Privacy Policy including the General Terms and Conditions stated below and Voter’s act of participation in the Voting Activity will be deemed acceptance to abide by the same.

 

  1. GENERAL TERMS AND CONDITIONS

 

  1. Participation in the Voting Activity for voting on all Entry Platforms is open to audience worldwide

 

  1. Persons must submit the Voting Entries on their own behalf and Voting Entry (ies) by proxy will not be accepted, even for their family members.

 

  1. The Company reserves all rights to make amendments to the existing Terms and Conditions or withdraw the Voting Activity without giving prior notice. It shall be the sole responsibility of the Voter(s) to check the Terms and Conditions of the Voting Activity on the website of the Company/ Event i.e. zeecineawards.com

 

  1. The Voter hereby undertakes, warrants and guarantees to the Company that he/she has full legal capacity to participate in the Voting Activity in accordance with law and also these Terms and Conditions.

 

  1. The Voter understands and agrees that the Company shall not be responsible in any manner whatsoever for any Nominee being been not selected as a Winner post counting of the Voting Entries received on the Voting Platforms from the Voters throughout India. The Company shall not entertain any complaints from the Voters or any person related to the Voter in relation to the Voting Activity of the Event.

 

  1. The Voter acknowledges that he/she has voluntarily chosen to participate in the Voting Activity at his/her free-will and is willing to bear all risk, costs and consequences arising from such participation in the Voting Activity.

 

  1. Voter(s) who do not comply with these Terms and Conditions, or who attempt to interfere with the process of Voting Activity or the operation of the Voting Platforms in any way shall be disqualified and the Voting Entries submitted shall not be counted.    

 

  1. Casting of a vote shall construe acceptance of these Rules and Regulations even if the same is not explicitly mentioned by the Voter. The Company shall not be responsible for delayed receipt or non-receipt or incomplete receipt or corrupt receipt of votes.

                                         

  1. All Voting Entries received by the Company shall be subject to verification to automatic, programmed, robotic or similar means of voting are permitted.

 

  1. The Company reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend Voting Entries submitted by the Voter, should any virus, bug, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the voting process. The decision of usability of the Voting Entries received by the Company shall be decided by the Company at its sole discretion.

 

  1. The Company makes no representations, warranties nor provides any undertaking to any of the Voter(s) that any or all of the Voters will be able to qualify for being eligible to get the opportunity of participating in the Voting Activity.

 

  1. The Company shall not be liable / responsible for any lost opportunity, damages, losses, costs, expenses or otherwise suffered / incurred by any of the Voter(s) in the event that the Company is not able to permit the Voter to take part in the Voting Activity in accordance with any of the foregoing provisions.

 

  1. Notwithstanding any other provisions mentioned herein, the Company may, at its sole and absolute discretion, cancel or reschedule the dates for such Voting Activity and at such date and place as it may determine.

 

  1. At no point of time will the Company be obliged to notify the Voter, the Voting Entry of whom has been disqualified by the Company.

 

  1. The Voter(s) shall hold harmless and indemnify, the Company, its affiliates, its group companies, their employees, officers, directors or any other person from and against any injury/damage/harm/loss/ death/ mental or emotional trauma suffered by the Voter(s) and/or the Voter in connection with the Voting Activity and also to the extent possible under law, waives all rights to file in person/ through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India to claim any damages or reliefs.

 

  1. The Voter shall hold harmless and indemnify the Company, its affiliates, its group companies, their employees, officers, directors and/or any other person from and against any suit/litigation/injury/damage/harm/loss suffered by the Company in connection with any act of the Voter and/or the Voting Activity and/or post and/or Voting Entry and/or any third party rights claims with respect to the material submitted by the Voters(s).

 

  1. The Voter(s) shall not hold the Company, its affiliates, contractors, partners, vendors and promotion and advertising agencies responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of voting information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit Voter’s ability to vote, including any injury or damage to Voters or any other person’s mobile device or land line relating to or resulting from participating in the Voting Activity or downloading any materials. The Company and/or its representatives shall not be responsible for lost, late, illegible, incomplete, invalid, unintelligible, technically corrupted or misdirected votes, which shall be disqualified. The Company shall attempt to use commercially reasonable efforts to ensure the security and accuracy of all Voting Entries and the methodologies/ processes/ mechanisms of said Voting Entries however the Voters hereby acknowledge and agree that such methodologies/ processes/ mechanisms are not infallible, and that the Company makes no guarantee as to its effectiveness.

 

  1. All Voting Entries and/or any kind of data received by the Company and/or Voting Platforms shall be stored, maintained or shared in accordance with the Company/Voting Platform’s privacy policy and the Company/ Voting Platforms shall at no time be under any kind of obligation to discard or maintain the said information received from the Voter.

 

  • OTHER TERMS

 

  1. If any provision of these Terms and Conditions is held by any court or other competent authority to be void or unenforceable in whole or part, the other provisions of these Terms and Conditions and the remainder of the affected provisions shall continue to be valid.

 

  1. These Terms and Conditions shall be governed by and construed in accordance with the laws of India and subject to exclusive jurisdiction of the competent Courts in Mumbai.

 

  1. The Company is empowered to take a decision on any case not covered by the present Terms and Conditions and the said decisions shall be considered as final and binding on the Voters.

 

  1. Each provision of this Terms and Conditions shall be considered severable, and if for any reason any provision(s), or the application of such provision(s) to any person, entity or circumstance, shall be held invalid or unenforceable, such provision(s) shall be ineffective to the extent of such invalidity or unenforceability without invalidating the remaining provisions hereof, or the application of the affected provision to persons, entities or circumstances other than those to which it was held invalid or unenforceable.

 

  1. NO LIABILITY

 

  1. The Company is in no manner whatsoever responsible and/or shall not be held liable, for any physical injury, death, mental trauma caused to any Voter in any manner whatsoever, in relation to participation in the Voting Activity.

 

  1. The Company, shall be under no liability whatsoever to the Voters, in respect of any loss, damage suffered by the Voters arising from or pursuant to the participation in the Voting Activity or for any and all loss, damage, cost, expense or injury to life or property sustained by the Voter at any stage of the Voting Activity whether or not caused by (1) the Voter’s participation in the Voting Activity; (2) as a result of the any decisions of the Company for any matter relating to the Voting Activity; (3) as a result of any comment, remark, judgment, view, criticism, critique, opinion and/or observation in relation to any Nominee made and/or passed by the mentor appointed by the Company for the Event. Notwithstanding the generality of the foregoing, the Company expressly excludes liability for all direct, indirect and consequential loss or damage, including but not limited to loss or damage to property or for loss of profit, business, revenue, goodwill or anticipated savings pursuant to participation in the Voting Activity. In no event will the measure of damages include, nor will the Company be liable for, any amounts for indirect, incidental, consequential, or punitive damages of any party, including third parties; or for damages attributable to the Voter; or circumstances beyond the Company’s reasonable control.

 

  1. The Voter agrees that he/she shall hold harmless the Company, their affiliates, subsidiaries, group companies, their respective employees, officers, sub-contractors, vendors or any other person in connection with the Event and/or the Voting Activity including but not limited to persons connected to the Voting Entries counting procedure and/or elimination procedure based on the number of Voting Entries received and recorded with the Company and/or any increase/decrease in the charges charged to the Voter by his/her network provider for submitting the Voting Entries.

 

  1. The Company or any of its affiliates will not be liable for any loss of earnings, employment or otherwise caused to the Voters and arising as a result of his/her participation in the Voting Activity, if selected.

 

  1. Company shall not be held accountable/liable for any disruptions/stoppages/ interruptions or cancellation of the production of the Event and/or conducting the Voting Activity on account of any force majeure factors or otherwise.

 

  1. Company shall not be held responsible or accountable for any expenses (including but not limited to charges charged by the network providers for each Voting Entry submitted by the Voter), loss, or any other liability which may arise due to the Voter submitting Voting Entries on the Voting Platforms.

 

  1. The Voter hereby agrees to indemnify the Company or its affiliates against any claims that might arise from his/her actions or omissions while participating in the Voting Activity or due to any representations, misrepresentations or concealment of material facts by the Voter.
